5. Content Ownership

All content, features, and functionality on the services, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, and software, are the exclusive property of Steamrising or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the services for your personal or internal business purposes. This license does not include any resale or commercial use of the services or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of the services or its contents; or any use of data mining, robots, or similar data gathering and extraction tools.

Any unauthorized use of the services or its contents will terminate the permission or license granted by Steamrising. All rights not expressly granted herein are reserved by Steamrising.

6. User-Generated Content

Users may have the opportunity to submit, post, or otherwise make available content through the services ("User-Generated Content"). By submitting User-Generated Content, you grant Steamrising a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

You represent and warrant that you own or have the necessary rights to the User-Generated Content you submit and that such content does not infringe upon the rights of any third party. Steamrising does not endorse any User-Generated Content and expressly disclaims any and all liability in connection with such content.

Steamrising reserves the right to remove or edit any User-Generated Content at its sole discretion, without notice, for any reason, including but not limited to violations of these Terms of Service or applicable laws.

7. Payment Terms

Access to certain features of the services may require payment of fees. By subscribing to our services, you agree to pay all applicable fees as outlined on our website. All fees are non-refundable unless otherwise stated. You are responsible for providing accurate billing information and for ensuring that your payment method is valid and up to date.

Steamrising reserves the right to change its pricing at any time, with notice provided to you prior to the effective date of the change. If you do not agree to the new pricing, you may cancel your subscription before the effective date of the change. Continued use of the services after the effective date of the change constitutes your acceptance of the new pricing.

8. Service Modifications

Steamrising reserves the right to modify or discontinue, temporarily or permanently, the services (or any part thereof) with or without notice. You agree that Steamrising will not be liable to you or to any third party for any modification, suspension, or discontinuance of the services.

We may also impose limits on certain features and services or restrict your access to parts or all of the services without notice or liability. You acknowledge that it is your responsibility to review these Terms of Service periodically for any changes. Your continued use of the services after any modifications constitutes your acceptance of the modified terms.

If you do not agree to the modifications, you must cease all use of the services immediately.

9. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Steamrising, its affiliates, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of, or inability to access or use, the services; (ii) any conduct or content of any third party on the services; (iii) any content obtained from the services; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

In no event shall Steamrising’s total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing the services during the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you. In such jurisdictions, Steamrising’s liability is limited to the greatest extent permitted by law.

10. Termination

These Terms of Service are effective until terminated by either party. You may terminate your account at any time by contacting us at [email protected]. Steamrising may terminate or suspend your account and access to the services at any time, without prior notice or liability, for any reason, including if you breach these Terms of Service.

Upon termination, your right to use the services will immediately cease, and you must cease all use of the services. All provisions of these Terms of Service which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Upon termination, you may request a copy of your User-Generated Content, and we will provide it to you in a reasonable format. However, we are not obligated to retain any User-Generated Content after termination.
